By accessing or using KeepOfEchoes ("the App"), you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App.

2. Description of Service

KeepOfEchoes is an iOS application that allows users to:

• Record voice conversations and stories
• Transcribe recordings using on-device AI
• Organize and search recorded content
• Share content with family members through iCloud
• Interact with Ember, an AI conversation companion

3. User Responsibilities

When using KeepOfEchoes, you agree to:

• Use the App only for lawful purposes
• Obtain consent from all individuals before recording them
• Not record confidential or privileged conversations without proper authorization
• Comply with all applicable local, state, and federal laws regarding recording conversations
• Not use the App to infringe on others' intellectual property rights
• Not attempt to reverse engineer, modify, or create derivative works of the App

4. Intellectual Property

Your Content: You retain all ownership rights to the recordings and transcripts you create using KeepOfEchoes. We do not claim any ownership over your content.

Our App: The KeepOfEchoes app, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our App.

5. Data and Privacy

Your use of KeepOfEchoes is also governed by our Privacy Policy, which describes how we handle (and don't handle) your data. Key points: all processing happens on your device, and we never access your recordings or transcripts.

6. iCloud and Family Sharing

If you choose to use iCloud sync or Family Sharing features:

• Your data will be stored in your iCloud account subject to Apple's terms
• You are responsible for managing access to shared content
• We are not responsible for content shared with other family members
• Apple's iCloud terms and conditions apply to stored data

7. Ember AI Companion

Ember is an AI-powered feature that provides conversation prompts and guidance. Please understand that:

• Ember's suggestions are AI-generated and may not always be appropriate for every situation
• Ember is not a substitute for professional advice (medical, legal, psychological, etc.)
• All Ember interactions are processed locally on your device
• You are responsible for the content of your responses to Ember's prompts

8. Disclaimers

KeepOfEchoes is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including:

• Merchantability and fitness for a particular purpose
• Accuracy or reliability of transcriptions
• Uninterrupted or error-free operation
• Security of data stored on your device

While we strive for accurate transcriptions, AI-generated text may contain errors. Always verify important information.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of KeepOfEchoes.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes through the App or by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new terms.

11. Termination

You may stop using KeepOfEchoes at any time by deleting the App from your device. We reserve the right to terminate or suspend access to our App for violations of these terms.

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law provisions.
